Our Standard Terms and Conditions - 2023/24

 

We want you to enjoy your relaxing break and we know that nobody likes rules, but the following will make the contractual arrangements between us clear and will enable us to provide the best level of accommodation and a calm and relaxing environment for you, and all of our guests, to enjoy. 

Terms and Conditions

1)     Acceptance of Terms

a)     By booking your cottage stay with us you agree to the following terms and conditions which form a legally binding contract between us.

b)     Please read these terms and conditions carefully.  If anything is unclear, or if there is something you need to discuss, please contact us.  

c)     We can only accept your booking for a cottage if you are over 18 at the time of booking and we reserve the right to refuse any booking without giving any reason.

d)     We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.

e)     To ensure that we can continue to provide the best level of accommodation, and for the protection of our other guests, please be aware that if you or any of your party seriously or consistently breach any of these terms and conditions we may cancel your booking and (if you are already staying in your cottage) ask you to leave your cottage early without refund or compensation. 

 

2)     Booking, Payments and Cancellations

a)     Please be aware that your booking will only be secure when we receive your deposit, so it is essential that you pay it as soon as possible and definitely no later than 4 days from your booking request. 

So please pay:

i)      a nonrefundable Booking Deposit of £100 (if you are booking your cottage more than 6 weeks in advance); or

ii)     the full cost of your cottage stay, (if you are booking your cottage 6 weeks or less before the first day of your cottage booking)

If we do not receive the payment within 4 days after your booking request, sadly we will release the cottage and it will once again become available for other guests to book.

b)     If you have paid a Booking Deposit, you will then need to pay the balance of the full cost of your cottage stay 6 weeks before the first day of the cottage booking.  If we do not receive the payment within this time, sadly we will have to cancel your booking and release the cottage so it will once again become available for other guests to book. 

c)     Please be aware that your Booking Deposit and full payment will be non-refundable in most instances once paid.

d)     If you cancel your booking (or we have to cancel your booking because you do not pay the balance of the price of the cottage 6 weeks before the first day of your cottage booking) we will not refund any monies that you have paid to us unless we are able to re-let the property on the dates that we had reserved that property for you, and even then, this may only be a partial repayment (see below). 

e)     We therefore strongly recommend that you have a holiday insurance policy to cover the full cost of your booking in case you need to cancel your cottage stay for any unavoidable reason including medical, financial or weather-related circumstances.

f)      If following your cancellation, we do subsequently re-let the cottage on the dates that we had originally reserved that cottage for you, we will refund to you any amount by which the re-letting payment, when taken together with payments received by you, exceeds the total price that you agreed to pay for renting the cottage, less the booking deposit of £100. We will make any refund payment to you once the payment for the replacement booking has been received by us in full.

g)     If there is a national lockdown or regional lockdown affecting PK Cottages at Bempton Mill or preventing travel from your home address (which you provided when booking) then we will cancel your booking and refund any monies that you have paid to us in full or, alternatively if you wish, retain those monies and move your booking to a later available date.   However, if you are prevented from enjoying your holiday for any other reason to do with COVID-19 including illness or the need to self isolate we will treat this as a cancellation by you and as set out above, no refund will be made.  Again, we strongly recommend that you have a holiday insurance policy to cover any such unfortunate circumstances.

h)     In the unlikely event that for any reason we cancel your booking (other than because of your failure to pay the balance of the full price 6 weeks before the first day of your cottage booking), we will refund to you in full all monies received from you.  This will be the full extent of our liability in such circumstances and no further payment or compensation shall be paid (see Waiver and Liability below).

 

3)     Damage and Cleaning Deposit

a)     We require you to pay a refundable Damage Deposit of £125 at the same time as you pay the balance of the full payment for your cottage stay. This deposit is to cover any damage to your cottage which incurs extra costs and could have an impact on the service we provide the next guests.

b)     Most of our guests respect our cottages and leave them as they found them ready for the next guests to enjoy and we know that accidents happen, and that fair wear and tear occurs, and the Damage Deposit is not for that.  Please let us know of any minor accidental damage or breakages during your stay (or if you notice that something is missing or damaged) so that we can find a replacement or make a repair for your benefit and the benefit of future guests.

c)     You agree to reimburse us for all reasonable costs (not just limited to the Damage Deposit) that we incur as detailed in paragraph 4K below or for cleaning of furnishings, towels or bedding soiled beyond normal wear, the replacement of any missing or broken equipment or keys and any significant repairs that are required after your stay in the cottage.

d)     We will repay the Damage Deposit to you as soon as possible, and no later than 7 days after the last day of your cottage booking, less any reasonable deductions as set out above.

  

4)     Use of your Cottage

a)     Your cottage will be available for you and your party from 4.00 pm on the first day of your cottage stay and must be vacated by 10.00am at the very latest on the last day of your booking to enable us to thoroughly clean and prepare the cottage for our next guests. Our cleaners need access from 10am and we will need to make an extra charge if you have not fully vacated the cottage by 10am.

b)     Your cottage booking can be for a maximum of 30 days and must only be for the purposes of a holiday or short break (and not for any other purpose or longer period). We cannot under any circumstance allow you to re-let or sublet the cottage, even if this is free of charge.

c)     Please provide us with the number of guests in your party at the time of booking and inform us if this changes before your cottage stay begins.  You should ensure that the number in your party does not exceed the maximum number of guests for the cottage as stated on our website unless this has been agreed with us in advance.  If you permit additional guests to stay with you in the cottage (other than those notified to us in advance) it will be a breach of these conditions. 

d)     Although we will make every effort not to disturb your stay, we reserve the right upon reasonable notice to enter your cottage for the purposes of essential maintenance or inspection.

e)     We will provide bed linen and towels (except beach towels). Gas and electric for your cottage stay is included at no extra charge. Charging of electric vehicles is not allowed by our insurance and is therefore strictly prohibited. Parking is available for a maximum of 2 cars for each cottage (free of charge).

f)      We will provide WiFi (free of charge) for your party's reasonable use during your cottage stay. Please note that this is rural broadband and has limitations and that if this stops working for any reason, we cannot provide you with any compensation. We will endeavor to get you back on-line asap but please be aware that we will only be able to do so during normal office hours.  You agree to ensure that use of the WiFi by your party is reasonable and lawful and in accordance with our separate WiFi Terms and Conditions which will be made available in your cottage.

g)     We operate a no smoking or vaping policy in all of our cottages and no naked flames (candles, tea lights, matches etc) are permitted.  Due to reported fire and safety incidents on a nationwide basis, we also do not allow E-cigarettes/vaping equipment to be used or charged inside your cottage. 

h)     Please ensure that your group does not use your cottage for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to your fellow guests or our neighbours.  In particular please ensure that noise levels are kept to a minimum, especially between 11 pm and 8 am.

i)      The supervision of children, babies, dogs and any adults requiring care remains your responsibility at all times.

j)      Please remember that the cottage is privately owned and is part of our home.  We hope that your party enjoys the facilities and ask you to ensure that they take good care of the cottage and its contents.

k)     Please leave your cottage clean and tidy on your day of departure and in a similar condition to when you arrive. We do not charge an additional cleaning charge and whilst we undertake a core clean of the cottage between guests, the cottage cost is based on the cottage being left in good condition so it does not require an extensive deep clean. If your cottage is left with unemptied bins, dirty toilets or bathrooms, or with sides, carpets or upholstery covered in food, hair, sand or other debris you will incur additional charges for deep cleaning. 

l)      Please remember to take all of your personal possessions with you on departure from your cottage.  Although we will, of course, make every effort to return high value items, we cannot accept any responsibility for personal possessions left in your cottage following departure and we will have to charge for the cost of returning any lost property.

 

5)     Bringing your Dog on Holiday

a)     We allow a maximum of 2 well behaved small/medium dogs in our cottages. Dogs must be booked in advance and so please select the option to add this as an extra when you place the booking.

b)     If you would like to bring your dog(s) with you, there will be an additional charge of £25 per stay. 

c)     For those guests with visual and hearing impairments, registered guide and hearing dogs are allowed in our dog suitable cottages without charge. Please just let us know before arrival.

d)     If you are bringing your dog(s), you agree to clean up after your dog both inside and outside of the cottage and to ensure that your dog is:

i)      quiet, properly controlled and supervised at all times;

ii)     never left unattended in your cottage;

iii)    not permitted in any of the bedrooms

iv)    not permitted on any of the furniture without use of a dog blanket;

v)     exercised and toileted either away from the cottage complex or within one of the two designated dog gardens on site

e)     You must always pick up after your dog using an appropriate pet poo bag and dispose of this in a designated bin.  Failure to pick up after your dog will incur extra charges

f)      If damage to your cottage or its contents is caused by your dog or extra cleaning is required, this will not be considered to be normal wear and tear and we will charge you for reasonable cleaning, repair or replacement costs

g)     Because of the above, we are afraid that if you suffer with allergies you should be aware that we cannot guarantee that there have been no dogs previously in your cottage, nor can we accept any liability for any suffering which may occur as a result of such pets having been present.

 

6)     Complaints

a)     We will make every effort to ensure that you have an enjoyable stay. However, if you experience any problem or have any cause for complaint, please let us know immediately.  We don't want your stay to be negatively impacted in any way by any niggle, concern or issue.  Should any such unfortunate circumstance arise, we would like to hear about this as soon as possible so that we have the best chance of rectifying things so that you can concentrate on enjoying your stay.

 

7)      Waiver and Liability

a)     Our failure to enforce or exercise, at any time or for any period of time, any condition, or any right set out in these terms and conditions does not constitute and shall not be construed as a waiver by us of such term or right.

b)     We cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by events of force majeure (including without limitation) war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside its control.

c)     We exclude from our contractual arrangements all warranties, conditions and other terms implied by statute or common law, to the fullest extent permitted by law.  Nothing in these terms and conditions excludes or limits our liability for death or personal injury caused by negligence or fraudulent misrepresentation.

d)     You must take all necessary steps to safeguard yourselves and your property and we do not accept any liability for loss, damage or theft of personal property belonging to guests (including pets), either in your cottage or in/to cars, bicycles or other vehicles left on the cottage complex. Nor shall liability be accepted by us for accident or injury to guests, either within the cottages or on the cottage complex except to the extent such personal injury or death is caused by our negligence or wilful default.

e)     We shall not be liable for (or compensate for) any temporary outage of electricity, gas, water, internet connection or television service, or any temporary defect or malfunction of any equipment, machinery or appliance in the building or grounds during your cottage stay.

f)      Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the performance of the contract between us shall be limited to a sum equal to payments you have made to us and we shall not be liable to you for any type of indirect or consequential loss or damage, costs, expenses or other claims for consequential compensation whatsoever (however so caused). 

g)     Save for any rights under these terms and condition which may be exercised by us, not term or condition is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to our contract made under these terms and conditions.
